A Motion to Compel is how you tell the Judge the Plaintiff did not follow the court's rules. It lets you ask the court to Order the Plaintiff to give you documents and answer your questions about the case. Instructions
- Your motion is on the next page. If it is not, type "Ctrl" + "Enter" before the heading, COMMONWEALTH OF MASSACHUSETTS.
- Review the motion and make sure everything it says is true and is spelled correctly.
- In the "Notice of Hearing" section write the date and time of the hearing.
- To get a hearing date, bring your motion to the Court or call the clerk's office. You can find the clerk's number for your court by looking up the court house at: http://www.mass.gov/courts/court-info/courthouses/.
- Ask the clerk when "Motion Day" is.
- The clerk will tell you a day and time the court hears motions every week.

- Make two copies of everything.
- Give the original motion to the court clerk.
- Mail a copy to the plaintiff.
- Keep a copy for yourself.
- Prepare for the hearing. Be ready to tell the court exactly what information you need and why you need the documents and questions answered. For example, a good reason is that the Plaintiff cannot prove where they came up with the amount they say you owe.
- Go to court on the hearing date.
